The EPO's "10-day notification rule"

On and after November 1, 2023 the EPO's "10-day notification rule" will no longer apply to communications issued by the EPO.

Thus, if the EPO issues, for instance, a communication pursuant to Article 94(3) EPC on November 5, 2023, this communication will be deemed to be delivered on November 5, 2023. This date starts the four-month period for reply, which accordingly needs to be filed on or before March 5, 2024.

The 10-day rule will continue to apply to communications issued by the EPO on or before October 31, 2023.

•   Problems and pitfalls when using ChatGPT

The speakers will highlight recent developments and trends in these areas.

The panel includes Dr. Michael A. Sartori from McCarter & English, USA; Shengping Yang of Zhifan IP Attorneys, China; Shikato Shunsuke of JETRO Dusseldorf and as a representative of JPO in Europe; and Dr. Johannes Graf Ballestrem of Osborne Clarke, Germany. Dr. Marcel Wever from the Ludwig-Maximilians-University Munich will complement the panel.

Kraus & Weisert filed the first opt-out request in history

On March 1, 2023 the sunrise period for opting out EP patents and applications started. Kraus & Weisert was ready from the start and filed the first three opt-out requests in the (so far, short) history of the Unified Patent Court. After filing the 19th patent application with the European Patent Office in 1978, this is again proof of our speed and efficiency in handling client matters.

Our partner Dr. Claus Beckmann who overlooked the setting up of our IT systems says: "We successfully opted out the first EP patent 8 minutes after the start of the system. Of course, we will follow the hopefully exiting development of the unitary patent system and Unified patent court and be ready to act for our clients." (see also here >>>)

 

Germany has ratified the Agreement on a Unified Patent Court

On February 17, 2023 the Federal Ministry of Justice announced that Germany has ratified the Agreement on the Unified Patent Court (see here >>>) .

With Germany's ratification the Agreement will definitely enter into force on June 1, 2023.


Starting on March 1, 2023 requests for opting out a patent or application from the UPC can be filed. Further information can be found here >>>

Start of the UPC Sunrise Period postponed to March 1, 2023

The UPC announced on December 5, 2022 that the start of the Sunrise Period is postponed for two months. The Sunrise Period will accordingly start on March 1, 2023 followed by the entry into force of the UPCA on June 1, 2023. An updated version of our UPC brochure can be found here >>>

Update: new speaker in our March 10, 2020 seminar

There are still a few vacant places for our seminar on international patent matters, held in Munich on Tuesday, March 10, 2020. The seminar provides a unique possibility to obtain first-hand insights from internationally renowned speakers and experienced practitioners. The seminar will provide ample opportunity for networking, including an informal closing reception.

Further, due to travel restrictions associated with the pneumonia situation in China, our invited speaker from China, Mr. Xiaolin Huang, will unfortunately not be able to attend. To be nonetheless able to provide an update on patent-matters in China, our associate Mr. Haidong Hao (Chinese Patent Attorney Qualification) will present on the Chinese practice. Mr. Hao has been permanently based in our Munich office since the beginning of 2019. Prior to joining Kraus & Weisert, Mr. Hao has gathered many years of experience as an in-house patent counsel for Chinese companies. He will enrich the discussion with insights of the Chinese patent landscape from an in-house perspective.

Seminar – March 10, 2020

On March 10, 2020, we will be hosting our second international seminar at the Hilton Hotel in Munich. Speakers from China, South Korea, Japan, the US and Germany will provide insights on examination matters in different jurisdictions including information on basic requirements and best practice for claims and embodiments in the field of Artificial Intelligence and flexibility in making amendments.
